Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Fly Tyer's Bench ("Company," "we," "our," or "us") governing your use of the Fly Tyer's Bench mobile application ("App").

By downloading, installing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you are at least 13 years old and have the legal capacity to enter into these Terms.

3. Account Registration

To access certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your password
  • Promptly update any information that changes
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized use

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Description of Service

Fly Tyer's Bench provides:

  • Material scanning: Using your device's camera and AI to identify fly tying materials
  • Inventory management: Tracking the materials you own
  • Pattern matching: Showing fly patterns you can tie with your materials
  • Community gallery: Sharing and viewing fly photos from other users

The App is provided as a tool to assist fly tyers. We do not guarantee the accuracy of material identification, pattern recommendations, or any other information provided.

5. User Content

Your Content

You retain ownership of any content you submit, including photos, inventory data, comments, and feedback. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the App, our websites, and authorized partner integrations.

Content Guidelines

You agree not to submit content that:

  • Infringes any intellectual property rights
  • Is illegal, harmful, threatening, abusive, or offensive
  • Contains malware or malicious code
  • Misrepresents your identity or affiliation
  • Violates any third party's privacy
  • Is spam or commercial solicitation

We may remove any content that violates these guidelines without notice and may suspend or terminate accounts of repeat offenders.

6. Acceptable Use

You agree not to:

  • Use the App for any illegal purpose
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Circumvent any security measures or access controls
  • Use automated systems (bots, scrapers) to access the App
  • Interfere with or disrupt the App's operation
  • Impersonate any person or entity
  • Collect information about other users without consent
  • Use the App to harass, abuse, or harm others

7. Pro Subscription

Subscription Terms

Fly Tyer's Bench offers a Pro subscription with additional features including unlimited scans, cloud sync, and more.

  • Subscriptions are billed through Apple App Store or Google Play Store
  • Payment will be charged to your App Store/Play Store account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel subscriptions in your device's account settings

Cancellation & Refunds

  • You may cancel at any time through your device's subscription settings
  • Cancellation takes effect at the end of the current billing period
  • No refunds for partial subscription periods
  • Refunds are subject to the policies of Apple App Store or Google Play Store

8. Third-Party Services

The App integrates with third-party services including Supabase (authentication and database), OpenAI (material identification), and RevenueCat (subscription management). Your use of these services is governed by their respective terms and privacy policies. We are not responsible for the practices of third-party services.

9. Intellectual Property

The App and its contents, including software, design, logos, pattern database, and material taxonomy, are owned by Fly Tyer's Bench or our licensors and protected by intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

  • The App will be uninterrupted or error-free
  • AI material identification will be accurate
  • Pattern recommendations will be suitable for your needs
  • The App will meet your expectations

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.

Our total liability shall not exceed the greater of: (a) the amount you paid for Pro subscriptions in the past 12 months, or (b) fifty dollars ($50).

12. Your Data Rights

You have the right to access, correct, and delete your personal data. You can:

  • Delete individual inventory items by swiping left
  • Delete all inventory data in Settings → Delete All Data
  • Delete your entire account in Settings → Account → Delete Account
  • Request data deletion by emailing greg@flytyersbench.app

13. Termination

You may terminate your account at any time by deleting your account in the App settings or contacting us. We may suspend or terminate your account if you violate these Terms or if we discontinue the App.

Upon termination, your license to use the App ends immediately. Provisions that should survive termination (such as Limitation of Liability) will remain in effect.

14. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

  • These Terms are between you and Fly Tyer's Bench only, not with Apple. Fly Tyer's Bench is solely responsible for the App and its content.
  • Apple has no obligation to provide maintenance or support services for the App.
  • In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
  • Apple is not responsible for addressing any claims relating to the App, including product liability claims, regulatory compliance, or intellectual property claims.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting updated Terms in the App or sending an email. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms. If you do not agree, you must stop using the App.

16. Governing Law

These Terms shall be governed by the laws of the State of Texas, without regard to conflict of law principles.
